County liquor license approved for proposed Mitchell steakhouse on Highway 37 bypass

Nov. 27 – MITCHELL – Mitchell’s newest planned restaurant received approval this week to obtain a liquor license from Davison County to move forward with plans for a fine dining destination along the State Highway 37 bypass.

The Davison County Commission voted 5-0 to grant a retail liquor license to Commerce Marketing Group II, which is developing a restaurant near the West 15th Avenue and Commerce Street location. CJM Consulting owns the land, and Mitchell developer Chuck Mauszycki Jr. spoke about the plans at the commission’s meeting on Tuesday.

“We’re pretty excited. If we don’t get this done, it would be a big blow for us, but it’s just the first step,” Mauszycki told the board before the commission’s vote. “We have a good plan.”

Don Petersen, an attorney representing the developers, said plans are being met with investors but cannot move forward without a liquor license. Petersen said the restaurant will have a steakhouse-style feel.

“The plans are for a fine dining restaurant and Chuck is currently working with investors to secure financing. But the plans are in place,” Petersen said.

Plans shared with county commissioners show a 12,765-square-foot building that calls for an event patio, a banquet area, bar and dining room, meeting room space and a casino.

The license fee is $78,016, the proceeds of which are split between the county and the South Dakota Department of Revenue. This figure is based on the population of the county and is set at $4 per person in the county.

Interestingly, although the parcel is surrounded by land on all four sides in the city, it is the only piece of land outside Mitchell city limits along the beltway, allowing it to be subject to the county’s liquor license process.

If that land is eventually annexed to the city, the business can continue to use the license and the county can potentially issue another license to a future business because it no longer counts against the county’s dedication.

No construction date or timeline was shared during the meeting.
