Court Rejects Case Filed Against Appointment of NDDC Chairman

Court Rejects Case Filed Against Appointment of NDDC Chairman

The Federal High Court sitting in Abuja has dismissed the suit filed by oil producing communities in Bayelsa and Delta State.

The communities approached the Court to invalidate the alleged illegal appointment of President Tinubu to the Niger Delta Development Commission (NDDC).

In their lawsuit, the plaintiffs argued that Chiedu Ebie, an appointee of President Tinubu, was not qualified to chair the board of directors of the NDDC because he was not from the “oil producing region with the highest amount of oil production.”

Delivering the verdict, Justice Joyce Abdulmalki stated that the plaintiff has no locus standi under Section 24(2) of the NDDC Act.

Notwithstanding anything contained in any other statute or law, there will be no liability against any member of the Board of Directors, the Director General or any officer or employee of the Commission for any action taken for the purpose of administering or enforcing this Act or any other statute. A lawsuit will not be filed. “There shall be lien or institution established in any court of law or in relation to any alleged negligence or default in the exercise of any law or any public duty or authority, or in the execution of this Law or any such law or law, duty or power.”

For this reason, the court rejected the case completely.
