HC upholds life sentence of former MLA for murdering his wife

Cutting: orissa high court dismissed former MLA’s appeal Ram Murti Gamango (79) confirmed his claim life imprisonment For murdering his wife 29 years ago. Gamango’s wife Sashirekha was found dead in the MLA’s flat in Bhubaneswar on 29 August 1995.
The HC directed Gamango, who was out on bail, to surrender before the court to accept the punishment and pay a fine of Rs 50,000.
“The conviction of the appellant under Sections 302 (murder) and 201 (disappearance of evidence) of the IPC is conclusively proved,” a two-judge bench comprising Justices SK Sahoo and Chittaranjan Dash said on Wednesday while dismissing Gamango’s appeal.
“The prosecution finds beyond reasonable doubt that the appellant deliberately caused the death of his wife by fulfilling the requirements of Section 302 of the IPC in relation to murder. “The forensic findings, including the decedent’s antemortem injuries, the institution of the windpipe showing inhalation during the fire, and the appellant’s unconvincing claims of suicide, all discredit any hypothesis other than premeditated murder,” the court ruled.
“The delay in responding to the scene and calling the authorities without resorting to urgent medical assistance clearly reflects an intention to mislead and obstruct the course of justice. “Each element of Section 201 is satisfied because appellant’s actions were intended to protect himself from liability by erasing critical evidence of the crime,” the panel added.
The third additional sessions judge, Bhubaneswar, sentenced Gamango to life imprisonment on June 27, 2023. Gamango filed a criminal complaint with the HC the same year. He was released on bail during the hearing. While he was in custody, the HC granted him bail on August 11, 2023 and stayed the execution of the sentence until his appeal was resolved.

A special POCSO court in Jalaun district sentenced a 60-year-old man to life imprisonment and a fine of 5 lakh rupees for raping a six-year-old girl. The District Magistrate ensured a speedy investigation and submission of the charge sheet within 16 days. The court also directed Rs 3 lakh from the fine to be set aside for rehabilitation of the victim.
