SC issues notice on retired Army officer’s plea to quash ‘fake’ rape case

New Delhi, 5 November: The Supreme Court issued a notice in response to the petition of retired army officer Captain Rakesh Walia, who sought to quash the rape case filed against him on the grounds that it was false. Captain Walia, a senior citizen, alleged that the accusations were baseless and part of a pattern as the woman in question had reportedly filed seven cases of rape and harassment against nine men in various police stations in Delhi in the last eight years.

According to the police investigation, there were inconsistencies in the woman’s allegations; these included records showing that he was on the phone when he claimed the attack occurred; This refuted the claim that she had been drugged and raped in a car. Captain Walia, a cancer survivor who suffered a heart attack due to the stress of this case, stated that he was asked to pay 2 lakh rupees to avoid further legal trouble but chose to fight the charges instead.

Captain Walia’s legal defense is supported by Ekam Nyaay Foundation and he is represented in court by lawyer Ashwani Dubey. The Foundation stood by Captain Walia in his fight for justice and underlined its commitment to support the victims of the allegedly false accusations.

In a similar case, the Karnataka High Court recently quashed a Section 498A case filed against a man; It was revealed here that the woman filed 10 rape and harassment cases against various people over the years.
