Montana voters projected to include abortion protections in state constitution

Scripps News and Decision Desk Headquarters project Montana will pass a measure that would provide constitutional protection for abortion rights.

Montana size CI-128 A clear constitutional right to abortion would be added in the state.

Abortion protections in the state are currently based on precedents set in previous legal cases. The Montana Supreme Court ruled in 1999 that abortion was protected under the state’s constitutional right to privacy up to the point of validity.

The exact timing of viability depends on a number of factors, but the commonly accepted time range is 24-28 weeks of pregnancy. It is after the week.

The statement added within the scope of the new measure will include the following statement: “A person has the right to make and implement decisions regarding his or her own pregnancy, including the right to abortion.” There will be exceptions to extend the feasibility of abortion to the period of viability in order to preserve the life or health of the mother.

Montana currently allows abortion before fetus viability.
