Judge sentences Sioux City man to prison for home burglary

SIOUX CITY (KTIV) – A judge sentenced a Sioux City man to no more than 10 years in prison for his involvement in the robbery of a Sioux City home.

Ray Avila, 30, of Sioux City, received the sentence in district court on Wednesday, Oct. 30, according to court documents.

Avila was sentenced to 10 years in prison for second-degree burglary and 2 years in prison for third-degree burglary. Two other charges were also dropped as part of the plea agreement.

The sentence came after Avila was arrested for an incident that occurred. Sunday, August 19.

As previously reported, Sgt. Bluff police officers and Woodbury County deputies responded to a reported shooting at 5501 Old Lakeport Road at 11:07 p.m.

Documents say the homeowner said Avila and another person involved broke into the home. The homeowner said he was able to recognize Avila at the time of the incident because of a previous relationship between the homeowner’s girlfriend and Avila.

Avila reportedly entered the front door of the home and began shooting with what the homeowner believed was a pellet gun.

Authorities say nearly every window in the house was broken. This includes the south front door of the house and the door on the west side.

During an investigation, Woodbury County officers said they discovered the passenger side of the homeowner’s 2002 White Buick Century had been broken into.

Further investigation revealed that $500, three packs of Lucky Strike cigarettes and a multi-colored knife were stolen from the vehicle.

On the night of the incident, Avila was found driving a vehicle with a banned Iowa license during a traffic stop at 2nd Avenue and Rustin Street. Authorities said a pellet gun and mask were found in the vehicle’s center console during the search.

After the incident, Avila was charged with the following charges:

  • Second degree theft
  • Assault while participating in crime
  • Third degree burglary
  • Driving while prohibited
  • Domestic abuse attack due to injury or mental illness

Following the incident, Avila was transported to Woodbury County Jail.
