Sex crimes case against Kearney man moved to first instance court

KEARNEY, Neb. (KSNB) – The case against a Kearney man accusing him of sexually assaulting a child is headed to trial court.

Zachary Cole, 26, is charged with first-degree sexual assault of a child. On Wednesday, Cole waived his evidentiary hearing and his case was transferred to Buffalo County District Court for possible hearing.

He is expected to appear in court on December 20. At the hearing, the suspect usually pleads guilty or pleads not guilty to the charges against him.

Court records show Cole is accused of sexually assaulting a 13-year-old boy between February and June of this year.

At the request of the prosecution, the judge signed an affidavit containing the details of the case. The court order stated that the affidavit contained information that could endanger the safety of witnesses.

Cole is in the Buffalo County jail on $1 million bail. He was also ordered not to have contact with the victim.

Cole could face life in prison if convicted of sexual assault.
