New Delhi, Nov 14 (PTI) “Rape of a child is abhorrent”, a Delhi court observed while sentencing a 28-year-old man to 20 years rigorous imprisonment for raping an eight-year-old girl in 2016.

Additional Sessions Judge Babita Puniya was hearing arguments regarding the sentence imposed against the man convicted under Section 376 (2) of the IPC (rape of a girl under 16 years of age).

Special Public Prosecutor Sharawan Kumar Bishnoi demanded maximum punishment for this heinous act.

“Child rape is a very ugly thing. Children are the most valuable asset of a society. In its decision dated November 11, the court said that it is the duty of society not only to protect them from sexual violence and harassment, but also to make them happy.”

The court noted that the defendant committed the crime of kidnapping and raping the child on April 3, 2016, while he was going to a restaurant to buy noodles.

“What was supposed to be a simple and enjoyable outing turned out to be a violent and traumatic event (for the child) that would stay with him for the rest of his life,” he added.

The judge also rejected the argument that a lenient view should be taken because it was a case of digital influence.

“I don’t accept it. The legislature has not made any distinction between digital penetration and penile penetration. “According to the rape law, penetration can be penile/vaginal, penile/oral, penile/anal, object or finger/vaginal and object or finger/anal penetration,” he said.

The judge said the sentence must strike the right balance between crime and punishment.

“I think that a prison sentence of twenty (20) years is appropriate. “In my opinion, this will provide a fair punishment, adequate protection to society and make the convict understand the seriousness of his act, while also allowing for rehabilitation,” he said.

The court also awarded compensation of Rs 13.5 lakh to the victim. PTI MNR Inc.
