Lawyers for former Democratic New Jersey Sen. Bob Menendez criticized the government’s handling of evidence in his corruption case following a setback Monday.

The crash occurred when federal prosecutors inadvertently viewed nine exhibits containing unedited content that had been accidentally downloaded from a laptop used to manage evidence files. based on To The Hill. Menendez’s legal team called the incident “deeply troubling” in a letter to U.S. District Judge Sidney Stein.

Although prosecutors acknowledged the error to the court, they argued that it should not affect Menendez’s conviction or require any corrective measures, The Hill reported. Menendez’s attorney, Adam Fee, expressed concern about the government’s attempt to minimize the problem.

“The government’s effort to downplay its latest discovery raises more questions about the government’s conduct than it answers,” said Menendez’s attorney, Adam Fee. Fee explained that the defense was kept in the dark about the error until about two weeks after prosecutors became aware of it, but they only learned of it last Wednesday through a letter from the prosecution.

Menendez’s defense also claims that prosecutors failed to thoroughly check the thousands of exhibits shown to jurors and did not preserve the original condition of those exhibits, according to media coverage. Instead, they allegedly wiped the laptop containing the evidence after the hearing.

In his interview with Judge Stein, Assistant U.S. Attorney Paul Monteleoni admitted that neither the prosecution nor the defense initially identified the error and that he underestimated the possibility that the unredacted information would influence the jury’s verdict, The Hill said. Monteleoni opposed a retrial, saying it was unnecessary given that jurors were unlikely to notice the error.

After evidence was revealed to have been mishandled, Menendez accused the prosecution of manipulating the evidence and told The Hill that the mistake proved they “cannot be trusted.” The legal team requested that Judge Stein prepare a briefing schedule to further examine the consequences of this prosecutorial error.
