Court documents related to Providence Nurse murder to be sealed

PORTLAND Ore. (KPTV) – A Washington County judge denied a request to make public documents in the case of Bryce Schubert, who is accused of kidnapping and killing Melissa Jubane in September.

The request to seal the search warrants and affidavits was brought by FOX 12 and two other Portland Media outlets in an effort to gain access to more information about the murder.

Authorities have released few details about the case, including where Jubane’s body was found or how he died.

The man accused of killing nurse Melissa Jubane was formally indicted on murder charges Monday afternoon at the Washington County Courthouse.

The hearing was held in the Washington County Courtroom, and the victim’s supporters spilled into the hallway.

The Deputy District Attorney and the Attorney General for Media presented their arguments before the judge made his decision.

The deputy attorney general argued that sealing the court documents would interfere with the ongoing investigation.

“If this 50-page affidavit and the PC affidavit were unsealed, it would unleash an army of reporters and others who are tracking down important key witnesses, some of whom are afraid to become involved, and the question of whether to derail what’s going on right now.” is coming out,” said Chief Deputy Prosecutor Jeff Lesowski.

The chief media advocate argued that they needed the materials to see the full picture of the murder.

“What we’re talking about here is not access to something that’s not in the court file. We request access to documents submitted to the court in a criminal investigation. “These are essential sentencing materials that form the basis of the administration of justice in this court,” said Tim Cunningham, a lawyer for the media groups.

The judge denied the media’s request to seal the court documents.

“I refuse the request to open the records for various reasons and will keep a clear record… In my opinion, this investigation is ongoing, it is not yet completed and this may cause problems for the case. said Judge Rebecca Guptil
