Thane, Oct 27 (PTI) A court in Maharashtra’s Thane district acquitted five persons accused of cruelty to a woman and attempt to induce miscarriage, observing that there was no evidence against them in the charge sheet.

Additional Sessions Judge Vasudha L Bhosale, in her order dated October 22, said filing criminal complaints without evidence increases the pendency of cases and wastes the court’s time, which it should give to sensitive and important matters.

“Making accusations without evidence has placed an excessive burden on the courts. This practice needs to be stopped. For this reason, an investigation must be launched in line with the instructions of the Supreme Court,” he said.

“A copy of the decision will be sent to the police commissioner for further investigation,” the court said in the decision announced on Saturday.

The court acquitted Shaharum Fakre Alam Shaikh (42), Fakre Alam Jaitul Aabdin Shaikh (64), Nafisa Fakre Alain Shaikh (59), Marim Fakre (37) and Aliya Fakre Alam Shaikh (37).

The prosecutor informed the court that the victim Najara met the defendant Shaharum in 2012 and they had a relationship, as a result of which she became pregnant.

The defendant was taken to two hospitals, offering to have an abortion. Here, the medical staff reported that the pregnancy could not be terminated due to its advanced stage.

The prosecutor’s office said that the victim’s brother called the couple home on September 19, 2013 and asked them to get married, and they got married the same day.

The woman alleged that her mother-in-law abused and tortured her mentally and physically.

The prosecutor’s office said that the victim gave birth to a daughter in January 2014, but the harassment continued.

The court ruled that the prosecution failed to prove that the husband or his relatives subjected the woman to cruelty.

He noted that the mother-in-law did not make an unlawful request, and that there was no evidence in the woman’s statement that she was tortured regarding an unlawful request.

The judge also noted that the investigating officer’s investigation was flawed.

He questioned why the charge sheet was submitted even though no crime had been committed under IPC articles 498A (cruelty in marriage), 313 (causing miscarriage without the consent of the woman) and there was no medical report.

The court also said that although the charge sheet has been filed, it is unclear whether the central committee appointed by the state government, which requires the district government advocate (DGP) or his representative to verify the charge sheet before filing a case, has been complied with.
