Lawyer predicts Daniel Penny likely to testify in Jordan Neely drowning trial

Daniel Penny, a 26-year-old veteran architecture student who strangled 30-year-old Jordan Neely to death in a subway car last year, will likely testify in his own defense. at the hearing Soon, according to a New York City defense attorney who has handled similar cases.

Penny is charged with involuntary manslaughter and criminally negligent homicide in Neely’s death.

He said lawyers for both sides painted a scene for jurors about what happened in that subway car. The prosecution tries to convince them that Penny went too far by carelessly or negligently causing Neely’s death. The defense tries to convince them that their actions were justified and reasonable.

“These types of cases use the justification defense, ‘Yes, I did the alleged act… but it’s not a crime because I was right to do it because of X, Y, and Z.'” Gelormino told Fox News Digital.

He noted that a number of witnesses called to the stand by the prosecution said they were already afraid, thought they were in danger and were worried about their children.
