BRYAN, Texas (KBTX) – A Bryan man was convicted and sentenced to serve the next 40 years in prison for the 2018 Aggravated Assault on a Public Servant.

An officer with the Bryan Police Department (BPD) was checking on the welfare of a man on the road on Thursday, September 18, 2018, when he found the man, identified as Earnest Johnson, outside the LaSalle Hotel. The officer reported seeing Johnson with drug paraphernalia, according to a statement from the Brazos County District Attorney’s Office.

Johnson ran away when the police officer approached him, then tripped and fell. A witness testified last week that Bryan began attacking the officer when he stood up. This witness and another bystander kept Johnson away from the officer until backup arrived.

“Ultimately, it took more than five officers to take Johnson into custody,” the DA’s office wrote.

During the fight, Johnson dislocated the officer’s shoulder enough to require surgery and he was sidelined from work for six months.

The prosecution said Johnson waived his right to a jury trial. Instead, his case was heard only by Judge John Brick of the 272nd District Court. Johnson testified in his own defense and denied breaking the law.

He was found guilty on August 27, 2024, and his sentencing hearing was held on November 21. There, the state said Johnson had three previous incarcerations for burglary convictions, intent to commit sexual assault and sex offender failure to comply. registry. These three sentences guarantee Johnson will spend at least 25 years in prison.
