Damien Heagney: Murder suspect’s mobile phone near reservoir

A prosecution lawyer asked the witness about the “intermittent use” of Mr McCourt’s mobile phone, which was obtained at various times from a mobile phone site covering the Pomeroy and Cappagh Reservoir areas on January 2, 3 and 4, 2022.

When asked whether it was “possible” that Mr McCourt’s mobile phone was “briefly near the reservoir” during these periods of time, the expert replied “that is true”.

The police were later questioned by a defense lawyer and accepted the suggestion that there were “limitations” in the cell site analysis.

The witness accepted this when asked whether it was correct to say that “there was no evidence identifying” Mr McCourt’s phone at the Cappagh reservoir.

The defense attorney then asked whether his client’s cell phone was connected to a cell site in the Pomeroy area, which covers the reservoir, “which might indicate that he was in a vehicle passing through that area on his way to another location.”

The witness again replied, “That’s true.”
