The Supreme Court Pointed out that the rate of consensual relationships turning into criminal cases after separation has increased

The Supreme Court on Tuesday flagged a “worrying trend” in alleged rape and infidelity where criminal laws are sought to be criminalized when long-term consensual relationships break down.

A bench comprising Justices BV Nagarathna and N Kotiswar Singh gave its verdict on an appeal filed by a man challenging the Bombay High Court’s February 2018 order rejecting his plea to quash the FIR lodged against him in Navi Mumbai.

The woman claimed that the man had repeatedly exploited her with false marriage promises.

The court panel said, “In our opinion, the longer the duration of the physical relationship between the partners, without the female partner’s objection and insistence on marriage, will be an indication of a consensual relationship rather than a relationship based on the man’s false promise of marriage.
