Can a Rape Victim who contracts HIV be given compensation under the Delhi Victim Compensation Scheme? The Supreme Court Will Decide

The Delhi High Court will decide whether a rape or sexual assault victim who contracted a sexually transmitted disease or HIV will be granted compensation under the Delhi Victim Compensation Scheme, 2018.

Judge Sanjeev Narula In 2017, it issued a statement regarding a claim by a woman who was sexually assaulted, which led to her contracting HIV, and sought greater compensation under the Scheme.

He was awarded Rs. 1,75,000 as interim compensation by the Delhi State Legal Services Authority under the Delhi Victim Compensation Scheme.

He was also awarded additional interim compensation of INR 1,00,000 as per the court order on November 11.

It was his case that the schemes under the Victim Compensation Scheme did not make any provision for the award of compensation, particularly in respect of the victim contracting a sexually transmitted disease or HIV as a result of the assault.

The court issued notice in the plea and sought response from the Government of Delhi and DSLSA.

The case will be heard on January 7, 2025.
