Augusta man charged with assaulting woman

AUGUSTA — An Augusta man who allegedly punched a woman in the head, slapped her hard enough to knock her to the ground and threatened to kill her was charged with domestic violence on Oct. 16.

Dustin E. Gay, 41, of Augusta, was indicted by a Kennebec County grand jury on two counts of domestic violence aggravated assault, two counts of domestic violence assault and one count of domestic violence criminal threatening.

The woman he allegedly attacked said that he punched her in the head, slapped her in the face so hard that she lost her balance and fell, and put a charging cable to her neck and said that she was going to kill her. When police interviewed him, they noted he had a red mark on his neck, blood on his head around his earring and that he was limping, according to an affidavit filed by Augusta Police Officer Erik Maheu.

The woman also said that the man initially hit her with his car and injured her leg. He later retracted this claim in his statement to the police and said that he followed her with his car while she was walking and thought he was going to hit her. He said he stopped and tried to get her into the car, but he stepped back, tripped and injured his foot.

He later told police he punched her in the ankle.

One of the two Class B domestic violence aggravated assault charges Gay is charged with still states that Gay “intentionally, knowingly or recklessly caused bodily injury” by “using a dangerous weapon, motor vehicle.” .” The penalty for a Class B felony is up to 10 years in prison.

The incidents allegedly occurred in Augusta on July 21, when the couple went to several bars and restaurants in the city and argued both outside and after returning home.

An indictment is not a finding of guilt, but it indicates that there is sufficient evidence to proceed to trial. The Kennebec County grand jury, which announced its findings on October 16, also indicted:

• Daniel D. Cram, 41, of Clinton, unlawful possession of scheduled drug (containing fentanyl powder), unlawful possession of scheduled drug (cocaine base) and refusing to submit to arrest, July 1, in Waterville; and aggravated trafficking in scheduled drugs (fentanyl powder), unlawful possession of scheduled drugs (methamphetamine), violation of conditions of release and unlawful possession of scheduled drugs (containing fentanyl powder), July 20, Waterville.

• Veronica R. Davila, 23, of Augusta, escape, June 10, in Augusta.

• Albert Jonathan DiPietro, 39, of Jay, burglary, two counts of theft by unauthorized taking and criminal mischief, July 5 in Rome.

• Sherry L. Gilley, 39, of Harpswell, unlawful possession of scheduled drug (involving methamphetamine), unlawful possession of scheduled drug (cocaine) and violation of condition of release, Aug. 19, Vassalboro.

• Nicholas C. Hunter, 46, of Waterville, theft without permission, April 23, Manchester; and theft by unauthorized taking on May 2 in Augusta; and theft by unauthorized taking on May 4 in Augusta.

• Misty Jean Ireland, 40, of Gardiner, aggravated trafficking in scheduled drugs (fentanyl powder) and unlawful possession of scheduled drugs (involving fentanyl powder), Aug. 13, Waterville.

• Ronjan Johnson, 44, of Brockton, Massachusetts, two counts of aggravated trafficking in scheduled drugs (fentanyl powder) on Feb. 12 in Albion.

• Jaymie L. LaChapelle, 39, Augusta, theft by unauthorized taking, March 2 in Augusta; and theft by unauthorized taking on March 4 in Augusta; and theft by unauthorized taking on March 3 in Augusta.

• Michael Joseph Gola Jr., 33, Oakland, domestic violence terrorizing, domestic violence criminal threats and harassment by telephone or electronic communications device, between Jan. 4 and Jan. 7. Kennebec County.
