Murder charges filed after September attack victim dies in Sioux Falls – Mitchell Republic

SIOUX FALLS — A Sioux Falls man faces new murder charges after the victim he accused of attacking in September died after being hospitalized for several weeks.

A Minnehaha County grand jury on Wednesday, Oct. 30, returned a superseding indictment charging first-degree murder against 32-year-old Sioux Falls resident Robin Swallow. The new indictment includes the original charges of first-degree kidnapping and aggravated assault filed in late September.

The murder charge comes after 64-year-old Michael Colvin died after a week-long stay at a Sioux Falls hospital. An autopsy confirmed the manner of death as homicide. Police did not specify the date of Colvin’s death.

According to Lt. Aaron Nyberg, the Sioux Falls Police Department responded to a call of an assault at the intersection of 12th Street and Cleveland Avenue on Sept. 22. Upon arrival, authorities found Colvin to have “serious injuries.”

Witnesses at the scene helped police identify Swallow as the suspect, and he was arrested the same day. Jail records say Swallow has been held without bail since then.

In early October, Swallow pleaded not guilty to charges of kidnapping and aggravated assault. He is scheduled for an additional hearing on the murder charge on November 4.

If convicted of first-degree murder, Swallow faces a minimum sentence of life in prison or a maximum prison sentence.
