State charges against former Cape Girardeau city councilman dismissed

CAPE GIRARDEAU, MO. (KFVS) – The former Cape Girardeau City councilman facing federal drug charges is no longer charged in state court.

Rhett Pierce, 54, is currently free on bail.

Cape Girardeau County Prosecutor Mark Welker said Monday he dismissed the state’s charges against Pierce.

Welker said the decision came after a review of the federal indictment against Pierce showed that he had been charged with the same conduct in both state and federal court. The indictment charges Pierce with possession of methamphetamine with intent to distribute and unlawful use of a controlled substance with a firearm.

Federal court documents show Pierce was forced to surrender his passport earlier this month as a condition of being released on bail.

The court’s deadline for preliminary hearing requests in his case was set as December 5.
