All charges against IU student dismissed except one rape

Monroe County Judge Valerie Haughton All charges except one rape charge against IU student Noah Apgar were dismissed. arrested 17 September.

Apgar was accused of raping two women on different occasions in the same week. He was initially charged with five counts of rape – level three felonies – one count of strangulation and one count of criminal confinement – both level six felonies.

A level six offense can result in a minimum of six months in prison with no fine, up to a maximum of 2.5 years in prison with a fine of up to $10,000. A level three crime can result in three to 16 years in prison.

Haughton denied the charges due to “evidence issues.” In the petition for dismissal filed by Deputy Prosecutor Rebecca K. Helmer on October 2, it was stated that “the State has currently failed to meet its burden of proof on these charges.”

According to Acting Attorney General Jeff Kehr, the court is still proceeding with a rape charge involving the second victim. A pretrial conference is scheduled for Nov. 25.
