An illegal immigrant who failed to show up for an immigration hearing after being released at the border was arrested for allegedly raping a five-year-old girl on Long Island, police said.

Details of the alleged rape, including Diaz’s relationship with the girl and where the incident occurred, were not immediately available.

Following the alleged attack, the child was taken to a local hospital for medical evaluation, police said.

Diaz, who lived in Westbury, crossed into the United States illegally near Rio Grande, Texas, in April 2014, according to police.

He was detained by US border agents but was later released after being served with a notice to appear before an immigration judge.

Diaz later failed to appear at an immigration court hearing, according to police.

Police said Immigration and Customs Enforcement had recently been notified of his arrest, without saying which country the suspect was originally from.

Diaz was arraigned last Wednesday on a number of charges including rape, attempted rape and endangering the welfare of a child.

He was being held on $200,000 cash bond.
