CBIA criminal complaint was filed 28 days ago against Roy, who conducted the investigation. The other two were arrested in connection with the August 9 rape and murder of the assistant doctor, former manager of RG Kar Sandip Ghosh and former Tala OC Abhijit Mandal were charged with tampering with evidence and conspiracy. They have not been charged yet.
The Sealdah court had earlier directed that the charges be framed on November 4 and ordered in-camera hearings to be held four days a week from November 5.
Roy was charged under BNS sections dealing with rape and murder. If proven, the charges could lead to the death penalty.
In the charge sheet filed on October 7, the CBI claimed that Roy’s involvement “in the commission of crime” has been “clearly established”. 11 items were put forward based on oral and documentary evidence, forensic reports and evidence against Roy. CCTV footage showed Roy was present on the third floor throughout the intervening night of 8 and 9 August. Call details records on his mobile phone also confirmed Roy’s presence on that floor. Roy’s lawyers stated that they would object to the charges.
The evidence against Roy is crucial: The police in charge of the case had previously seized jeans and shoes belonging to Roy, stained with the victim’s blood. DNA samples found on the victim’s body also matched Roy’s. It was also determined that Roy was injured between midnight on August 8 and noon on August 9, the time of the crime. A Bluetooth device found at the scene also matched Roy’s cell phone.
While the CBI did not give details of the allegations against Ghosh and Mandal, the agency alleged that Ghosh and Mandal’s “acts or omissions” sought to “hush up the matter”. He also accused them of trying to destroy evidence. Citing their role in the “larger conspiracy” and possible involvement of others, the CBI alleged that they may have been involved in the crime or abetment.
