New Process for Approval of License-Exempt Wireless Equipment

The Office of the Commissioner of Customs, Chennai-IV, has issued Public Notice No. 55/2024 on the approval process of license-exempt wireless equipment devices. As per CBIC Instruction No. 24/2024-Customs and a recent Office Notification of the Department of Telecommunications (DoT), Equipment Type Approval (ETA) for these devices can now be issued on a self-declaration basis. Importers and other stakeholders can apply for ETA through the SARAL Sanchar portal along with the required documents and fees. Applicants can download their ETA certificates from the portal after applying. However, ETA holders are required to obtain a No Objection Certificate (NOC) or other clearances from the Directorate General of Foreign Trade (DGFT) before importing the equipment. They must also ensure full compliance with all import regulations and requirements mandated by DGFT. This new process replaces some aspects of the previous Board Instructions (No. 16/2022-Customs). For implementation issues, stakeholders can contact the Chennai Customs office via the email provided. This notification also serves as a standing order to the officers of Export Commissionerate, Chennai-IV.

Sub: Issuance of Equipment Type Approval (ETA) for License Exempt Wireless Equipment Devices – Reg.

We invite the attention of importers, Customs Brokers and all other relevant stakeholders. CBIC Instruction No.24/2024- Customs Dated 22 OctoberAnd 2024 and is also invited to the Department of Telecommunications Department of Communications (DoT), WPC Wing Office Memorandum, R 11017/01/2018-PP (part-1) dated 09-09-2024 regarding publication of Equipment Type. Approval (ETA) for License-Exempt Wireless Equipment Devices as Ease of Doing Business in the telecommunications industry.

2.1 In the video above the OM, it is conveyed that all Equipment Type Approval (ETA) applications for wireless equipment devices exempted from licensing through various Gazette notifications published from time to time will be automatically granted to the applicant. declaration basis.

2.2 It was stated that in order to benefit from this facility, applicants must submit their applications (along with all necessary documents and fees) through the SARAL Sanchar portal. After successful application, candidates can download their ETA certificates from the portal.

3. In the said OM, it was also explained that these ETAs would be issued to ensure compliance with the RF regulation. Therefore, ETA holders must obtain a No Objection Certificate or other permits (if any) from the Directorate General of Foreign Trade (DGFT) before importing the equipment. It is the responsibility of ETA holders to ensure compliance with all import regulations and requirements prescribed by DGFT.

4. Previous Board Instruction no. Customs dated 16/2022-21.07.2022 has been changed to this extent.

5. If there is any difficulty in implementing this Public Notice, it may be reported to the Commissioner of Customs, Chennai-IV (Export) Commissionerate, Department of Customs, Chennai via e-mail. (email protected).

6. This Public Notice shall serve as Standing Order to the Officers of Chenni-IV (Export) Commissionerate.
