‘Thousands of representatives’ do not comply with material information rules

New research reveals thousands of agents still fail to comply with material information rules, leaving them vulnerable to prosecution and fines.

According to Moverly, more than 133,000 homes have been added to Britain’s property listings by agents without providing full material information.

Moverly says that failure to provide accurate material information could be considered a criminal offense under the Consumer Protection Against Unfair Trading Regulations Act, but there are hundreds of thousands of properties on the market today where material information is not fully provided.

Moverly, a provider of tangible information and digital property packages, looked at tenure information in Part A and parking details in Part B.

Four percent, or 20,700, of the estimated 523,257 properties currently listed are being marketed without including tenure information such as ownership or tenancy.

An even larger percentage of available postings in the three cities fail to provide tenure information. In Edinburgh, 12% of listings are missing relevant data, followed by Glasgow (10%) and Newcastle (7%).

When looking at the parking information required under Part B, the number of non-compliant listings increases even further.

Only 75% of live listings include information about parking, while the remaining 25%, or 133,161 properties, do not include this information.

In Glasgow the number of non-compliant listings rose to 36%, while in Newcastle the figure was 31%.

“Furthermore, the figures set out here do not even get into Part C of the material information, which relates to important issues that may affect the attractiveness of particular homes, including the risk of flooding and erosion.”
