Hearing of various motions in the Karen Read case set for today

DEDHAM – Today the judge will evaluate the joint motion of prosecutors and defense team for retrial Karen Read It will be postponed to April 1, 2025.

Judge Beverly Cannone declared a mistrial in the case in July. The second trial is scheduled to begin on January 27, 2025. The court confirmed last month: Cannone will oversee Read’s second trial.

At today’s hearing, Cannone will also consider various requests submitted by the defense; including a request to order Read to turn over her personal emails and cell phone data to Norfolk County District Attorney Michael Morrissey ahead of her second trial.

The prosecution and defense filed a joint motion to postpone the trial in Norfolk Superior Court earlier this month.

“The joint request would allow both the Commonwealth and the defense sufficient time to prepare for trial, accommodate the scheduling of new witnesses, including experts, allow for timely testing and disclosure by experts prior to trial, and produce a much longer outcome. “The proposal calls for a more efficient and orderly presentation of evidence by both parties,” the motion states. The motion states that prosecutors plan to retest the evidence and have retained a biomechanical engineer who is expected to testify at trial.

“These new Commonwealth experts are also expected to produce reports following testing and analysis, which defense will likely need time to consider and potentially respond to with its own additional experts,” the motion said. The statement is included.

Defense wants prosecutor’s phone records and seized transcripts at Read’s trial

The defense made several separate requests, such as Week; one of which requested personal emails and cell phone data from Norfolk County District Attorney Michael Morrissey.

The defense argues in its motion that Morrissey may have used his personal email and cell phone to contact Stoughton District Court staff and judges while Read’s case was previously pending in court.

In separate filings, Read’s attorneys are seeking relief from a warrant seizing the sidebar transcript that occurred on April 14, 2024, and also object to the testimony of the prosecution’s expert witness, Shanon Burgess, who examined Read’s Lexus SUV.

Karen Read charged with second-degree murder

Read was charged with second-degree murder, involuntary manslaughter and personal injury and leaving the scene of death while operating while intoxicated after O’Keefe’s body was found outside the Canton home of a fellow Boston police officer on Jan. 29, 2022. blizzard Prosecutors say Read was drunk and angry when he deliberately hit himself. Read is also charged with involuntary manslaughter while driving drunk and leaving the scene of personal injury and death. Norfolk District Attorney Michael Morrissey recently announced that he had appointed Special Assistant District Attorney Hank Brennan to lead Read’s retrial.
