CLERMONT COUNTY, Ohio (WXIX) – A murder suspect whose conviction for stabbing his mother to death was overturned by an appeals court has pleaded not guilty and not guilty by reason of insanity, new court filings show.

Joshua Amburgy, 41, returns to a Clermont County courtroom Wednesday for a plea or arraignment hearing at 1:15 p.m.

His attorney filed court documents Tuesday claiming Amburgy “is not competent to appear in court” and asking the court to “request a psychiatric evaluation of his current mental state.”

Previous court records show that his competency was questioned when the case first came before the court, but he was ultimately found competent to stand trial.

The convictions for aggravated murder and premeditated assault were overturned last month due to an error by an experienced judge, according to court records.

Since his conviction was overturned, his public defender wrote in court records that his previous pleas of not guilty and not guilty by reason of insanity “should automatically be reinstated.” However, in the ambulance, (Amburgy) reintroduces his previous plea of ​​not guilty as a precautionary measure and not guilty by reason of insanity…”

Ohio’s 12th Circuit Court of Appeals names Clermont County Common Pleas Court Judge Victor Haddad Failed to inform Amburgy of his constitutional rights during a plea hearing last year, according to a copy of the Oct. 7 ruling.

Amburgy pleaded guilty on Oct. 16, 2023, to felony murder and aggravated assault charges for stabbing his mother, Melissa Amburgy, 58, to death on Nov. 1, 2022, in the basement of their Miami Township home.

Judge Haddad, one of the Tri-State’s most experienced judges, sentenced him to 41 years in prison.
