SC sets up SIT to 'objectively and fairly' investigate rape of minor in Chennai

NEW DELHI: The Supreme Court on Monday constituted a three-member SIT, comprising DIG-rank IPS officer Saroj Kumar Thakur and women IPS officers Ayman Jamal and S Brinda, to investigate the September 29 incident in an “objective and fair” manner on a daily basis. The bench said that if the investigation is handed over to the CBI, no one will know what the outcome will be even after five to seven years. “It is better to create a SIT and let the HC monitor the progress,” he said. Thakur is joint commissioner of police (east), Greater Chennai, Jamal is deputy commissioner of police, Avadi is deputy commissioner of police (law and order) and Brinda is deputy commissioner of police in Salem. The SC directed the Tamil Nadu government and the DGP to partially relieve these officers from other responsibilities to complete the task assigned to them. Ordering the investigation to continue on a daily basis, the bench asked the SIT to submit an investigation progress report to the Madras HC on a weekly basis.
The bench requested the chief justice of Madras HC to constitute an appropriate panel to consider periodic investigation status reports.
Senior advocate Mukul Rohatgi, speaking on behalf of the state, requested the SC to examine the initial investigation status report and then give the task of monitoring the investigation to the HC. However, SC refused.
Rohatgi also said that the opposition was making political statements on the issue of sexual assault on a minor and requested the court to make appropriate observations to prevent them from politicizing the case.
The court asked the state to disregard political statements about the case and said that if we said anything, there would be many explanations about how their statements were distorted.
The rape victim’s mother was present in the SC courtroom along with her lawyer R Sampath Kumar during the hearings. The SC directed the Tamil Nadu government to pay the suit and miscellaneous expenses of Rs 75,000 within a week. on October 1 madras high court He had directed the CBI to investigate the case, saying that despite the repeated rape of a 10-year-old girl, the police harassed the parents and arrested the prime suspect 12 days later.
