The judge who oversaw Donald Trump’s silence trial in New York earlier this year is expected to decide today whether to throw out the president-elect’s guilty verdict.

The sentence for falsifying 34 business records was postponed until after the US presidential election, which Trump won.

With Trump returning to the White House in January, the court delayed emergency orders while the prosecution and Trump’s lawyers figured out what they thought would happen next.

Trump’s team is seeking to overturn the guilty verdict, citing the Supreme Court’s recent decision that grants presidents a degree of immunity from criminal prosecution. They say this applies to the hush money case.

The prosecution has until 10 a.m. EST to send Judge Juan Merchan their own thoughts on what the next steps should be.

Then it’s up to the judge.

If he reverses his conviction, it would be the end of Trump’s historic New York trial.
