Las Vegas police are investigating a shooting in which an officer killed a home invasion victim who called 911 for help.

Only later did authorities discover that the murdered man was living in the house and was trying to fend off the woman who had broken into his home.

The suspect, identified as Alejandra Boudreaux, was not fired upon. He was due to appear in court on Monday but refused to leave his jail cell. Members of Durham’s family wore shirts with his picture on them in court.

Boudreaux was ordered to appear next week.

Durham’s family is now demanding criminal charges be filed against the officer.

“We believe that an arrest warrant should be issued immediately. By legal standards, we believe that the grand jury should return an indictment for murder against this officer. It could be one murder, it could be two murders, but it would certainly be a criminal indictment against the officer,” said civil rights attorney Lee Merritt.

Durham’s 15-year-old daughter was home at the time of the shooting. He ordered her to hide in her room.
