The Kolkata High Court has allowed a Kolkata-based couple to conceive a child through in vitro fertilization (IVF), exceeding the age limit prescribed for such procedures. The order was given by Justice Amrita Sinha after the couple approached the Supreme Court after the foreign ministry’s permission was rejected.

The couple, who hails from Kolkata’s Kashipur district, had been married for 30 years but remained childless. Desperate to have a child, the 58-year-old husband and his 48-year-old wife turned to a fertility clinic, hoping to get pregnant through in vitro fertilization.

But the clinic turned down those offers, citing the state health department’s rule that the male partner must be under 55 for such treatments.

After the health ministry refused to grant exemption, the couple approached the Calcutta High Court for relief. In his order, Justice Sinha directed the fertility clinic to provide all necessary clinical support to the couple and ordered the state health department to extend full support to facilitate the procedure.

“This verdict is a ray of hope not only for this couple but also for many others who are deprived of the joy of parenthood due to strict age limits,” Justice Sinha said.
