Man accused of sexual assault in Overland Park previously convicted of attempted rape

A man in Kansas City, Kansas has been charged in connection with the following incident: A sexual assault occurred in Overland Park on Tuesday He was previously convicted of attempting to rape an 11-year-old girl in New York, according to court records.

Gabriel P. Hernandez, 37, was charged Thursday with rape, two counts of aggravated sodomy, one count of aggravated burglary and one count of burglary, according to Johnson County court records.

The alleged burglary and assault occurred around 2:40 a.m. Tuesday at a home near West 97th Circle and Reeder Drive in Overland Park.

Overland Park Police Chief Doreen Jokerst said the victim did not know Hernandez. Those with non-life-threatening injuries were transported to a local hospital early Tuesday morning.

Overland Park police arrested Hernandez Wednesday afternoon, according to court records. He is being held on a $750,000 bond.

According to the New York State Sex Offender Registry, the earlier assault occurred in 2006 when Hernandez was living in the Bronx, New York. According to records and New York court records, Hernandez dragged an 11-year-old girl into a stairwell on a street corner in the Bronx and allegedly put his hand over her mouth while trying to rape her.

In connection with the sexual assault, Hernandez was convicted in New York on February 7, 2008, of attempted first-degree sexual abuse, which carries a penalty of 16 months to four years in prison.

II, a category reserved for perpetrators of violent sexual crimes in New York. He was designated as a Tier 1 sex offender. He had refused to complete a court-recommended recidivism and treatment program designed for convicted sex offenders, according to court records.

On May 13, 2014, a New York appeals court rejected Hernandez’s bid to have his state registration downgraded to a lower tier.

Hernandez is due in Johnson County court on Dec. 5 for a preliminary hearing.
