Labor laws delayed as several states have yet to draft rules – Jobs and Career News

Five states/Union Territories are yet to release draft rules under three labor laws and four states’ fourth, the government said in Parliament on Monday, adding that the enactment of reformist laws may be further delayed.

These laws (Industrial Relations, Social Security and Occupational Safety and Wages) were passed by the Turkish Grand National Assembly in 2019 and 2020.

Minister of State for Labor and Employment Shobha Karandlaje informed the Lok Sabha on Monday that meetings were held with states/UTs to encourage them to frame draft rules under the Labor Laws. However, he added that the Center had already published its draft rules under the four codes as a step towards implementation.

States that have not formulated rules include West Bengal, Meghalaya and Nagaland. An official source had previously told FE that the Center aims to announce the implementation date of labor laws by next year.

Of course, labor laws fall into the concurrent list of the Constitution.

Therefore, both the Center and the states have the power to make rules. However, in case of a conflict between state laws and central laws, central laws generally take precedence unless the state laws receive the assent of the President.

The four labor laws are a logical combination of reforms aimed at facilitating labor Sunday eliminating rigidities and strengthening workers’ rights and welfare.

In order to strengthen trade and investment, facilitate the ease of doing business and facilitate compliance, nearly 44 Labor-related Laws were combined into four laws in 2019-2020. While some minor crimes were decriminalized through the law, due priority was given to skill development and conflict resolution.

Meanwhile, Karandlaje also said that in order to strengthen collective bargaining power, the government has introduced the concept of Negotiating Union and Negotiating Council for industrial organizations in the Industrial Relations Act 2020. “In addition, provisions for expanding the scope of social security benefits and social security measures for unorganized workers, including gig workers and platform workers, are also envisaged in the 2020 Social Security Law,” he said.
