Karnataka High Court reverses NCLT order blocking amendment of Aakash Institute Articles of Association

Aakash Education’s contention was that the NCLT’s order did not provide reasons as to why it stayed the Extraordinary General Meeting (EGM) decision to amend the Agreement. Justice Hemant Chandangoudar Stating that he agrees with the recommendations of the training company,

It is settled law that reasons are an objective expression of an opinion and the Court must substantiate its decisions in terms of legality, propriety and adherence to the principles of natural justice. Interim order as prayed for.”

However, the Court clarified that this interim decision is not a final opinion on the dispute. The case is expected to be heard on December 2 for further evaluation.
