The Lagos Court of Appeal has sentenced and acquitted Dr Olufemi Olaeleye wey bin chops to life imprisonment for alleged rape late last year.

Justice Olukayode Bada, leading the appeal panel on Friday, November 29, said in the lower court’s decision to convict the medical doctor, there was no evidence to suggest the doctor was responsible.

Judge Rahman Oshodi of the Lagos State Sexual Offenses and Domestic Violence Court sentenced Dr Olaleye to life imprisonment in October 2023, saying that when he was 16 years old, he raped a minor, his wife’s nephew. Since then, the doctor has been serving in prison.

Dr Olaleye is the medical director of the Lagos Optimal Cancer Care Foundation. The court described the doctor as “a dangerous criminal who showed no signs of remorse during the trial.”

The Court of Appeal’s decision was based on the fact that six of the prosecution witnesses appeared twice in the trial court. Dr. No evidence is shown that Olaleye committed rape, and there is no tally of the evidence.

According to the court, evidence shows that the doctor’s wife beat the little girl for two days, so we forced her to come forward to confess to the abuse.

“In my opinion, an application should be made to the lower court to not take the statement of the girl in question, so her statements do not count.”

The Supreme Court, Dr. He said the court made a mistake in sentencing based on the fact that Olaleye’s wife’s and daughter’s information were not tallied.

According to the Religious Law, the evidence presented by a child to the court is valid for the court.

The court also stated that there were inconsistencies between the evidence they presented to the court and the evidence in the medical report.

The court said, “There is no evidence of forced sexual intercourse between the two parties.”
