Woman Who Broke Her Tooth in an Ice Cream Sandwich on a Plane Sues JetBlue

A traveler filed a complaint against JetBlue this week, claiming he was served a “frozen solid” ice cream product during the flight that allegedly broke his tooth.

According to documents obtained by PEOPLE, passenger Kiara Quinonez claims JetBlue offered her a Nightingale brand strawberry shortcake ice cream sandwich before she suffered a mouth injury.

Quinonez filed a federal complaint against JetBlue in the Eastern District Court of New York on Tuesday, October 22; He claimed that the airline served him “food below a reasonable or safe temperature for consumption” and “did not warn him.” “From the dangerously cold temperature and solid state of the ice cream sandwich he was served.”

Quinonez’s attorney and JetBlue did not immediately respond to PEOPLE’s request for comment on Sunday, Oct. 27.

Quinonez was given a “chop-sized” ice cream sandwich while traveling with his fiancee on Flight 1907 from John F. Kennedy International Airport in New York City to Charles de Gaulle Airport in Paris on August 20.

He claims the dessert was “frozen solid” when served to him, causing him to “suffer serious bodily injury, including a fractured root of tooth No. 10, also known as the upper left lateral incisor.”

The passenger claimed that his dental injury required an emergency tooth extraction, subsequent implants, and additional care; The lawsuit alleges that the airline’s “negligent actions” caused her “pain, suffering and mental anguish.”

“As a direct and proximate result of the above-described actions of Defendant, its agents, and/or servants, Plaintiff suffered severe and permanent bodily injuries, suffered pain, suffering, and mental anguish, and incurred the expense of medical care and treatment, all of which the Complaint continues.” It was said.

The latest temperature-focused lawsuit comes more than three months after another JetBlue passenger filed a lawsuit claiming she suffered severe burns after a “dangerously hot” cup of tea was spilled on her during a flight from Orlando to Hartford, Conn., in May. came.

According to the lawsuit obtained by PEOPLE, a crew member allegedly “caused dangerously hot tea to spill” on passenger Tahjana Lewis, leaving her with injuries to her upper chest, breasts, legs, left hip and right arm, as well as injuries. “disfigurement and scarring.”

The incident also left her with “mental anguish, anxiety and post-traumatic stress,” according to the lawsuit.

A spokesperson for the airline did not respond to PEOPLE’s request for comment at the time.
