Trial held for four accused of high school break-in – Mitchell Republic

MITCHELL — Four people will be arraigned at the Davison County Public Safety Center during criminal court on Tuesday, Nov. 5, for the alleged break-in at Mitchell High School.

Elizabeth Dutchuk, 18, and Matthew Ruff, 19, both of Mitchell, Spencer Spillman, 18, and Brandan Spillman, 19, both of Alexandria, were charged with two counts of third-degree burglary in connection with Sept. 26. 2024, event. A police affidavit states an officer reviewed the tape overnight to identify individuals allegedly involved in the incident.

Mitchell Superintendent Joe Childs said the school district reported about $100 worth of beverages missing from the cafeteria cooler. A grand jury indicted the defendants on Oct. 11, following testimony from a Mitchell police detective. The hearing is the formal reading of the charges to the defendant.

Third-degree burglary is a Class 5 felony and is punishable, upon conviction, by up to five years in prison and a fine of up to $10,000.
